Election Tribunal grants leave on service

  BENIN CITY- The Election Tribunal sitting in Benin, Edo State, has granted leave to the petitioners in an election petition filed by Labour Party to serve the 8th respondent in the matter, Hon. Sam Omede by pasting the petition on the wall of his residence in Benin City.


The petition has the Labour Party, Hon Isaiah Osifo, Comrade Sunny Aguebor, Goodluck Aghedo and John Oghodaro as petitioners while the Action Congress of Nigeria (ACN), Sen Ehigie Edobor Uzamere, Rasaq Bello Osagie, Jim Adun, Hon. Samson Osagie, INEC Resident Electoral Commissioner, Hon. Sam Omede, Mr. Austin Odigie and the Commissioner of Police, Edo State as 1st, 2nd, 3rd, 4th, 5th, 6th, 7th, 8th, 8th, 10th, and 11th, respondents respectively.


Moving the motion ex-parte yesterday, counsel to the petitioners, Edward Aibangbee Esq leading E. Osaro, told the court that they have had difficulties in serving the 8th respondent through a substituted means.


In his prayers of six paragraphs affidavit and a written address to adopt his motion, the counsel prayed the court to grant leave to enable him serve the 8th respondent at his last place of residence at 60 Oko Central Road, off Oko/Ogba road in Benin City.


Having listened to the application, the Chairman of the Tribunal, Justice Paul Obi Elechi however granted leave to the applicant that the petition be pasted on the wall of the 8th respondent by any other means at No 60 Oko Central Road in Benin City.


In another development, the petition between Johnbull Asemota of the Peoples’ Democratic Party (PDP) and Elizabeth Uyinmwen Ativie of the Action Congress of Nigeria (ACN) was adjourned to today, Tuesday May 24, 2011.


The matter was adjourned at the instance of the petitioner’s counsel, N.I.T. Erhabor Esq who told the court that the 1st respondent only filed a written address and served them in the court hall yesterday morning, and prayed the court for a short adjournment.


Justice Elechi, then adjourned the matter to today to enable the counsel reply; noting that motion could only be taken after a pre-trial period.
