BENIN CITY – A Benin High Court, presided over by Justice Oseyi Oigbokie, has restrained the Peoples Democratic Party (PDP), its National Chairman, Chief Vincent Ogbulafor and its National Secretary, Alhaji Abubakar Kawu Baraje, (Defendants).
Also restrained are their agents, servants, privies or anybody acting under their authorities from suspending and/or dissolving any or all the plaintiffs/applicants in 17 local government area executive committee of the PDP, in Edo State (with the exception of Esan North East local government area) determination of the motion on notice before the court.
Giving her ruling in suit no B/424/OS/2008, yesterday, Hon. Oigbokie also restrained the defendants, their agents, servants, privies or anybody acting under their authority from removing the 17 local government executive committees of the party or from doing anything capable of affecting the tenure of the Executive Committee of the PDP pending the determination of the motion on notice before the court.
The defendants were also restrained from appointing, handpicking, or selecting or appointing a person or persons to function as members of the Executive Committee of the PDP in the Plaintiffs/Applicants respective local government areas, pending the determination of the motion on notice.
The defendants were similarly restrained from taking any further action whatsoever calculated to prejudice the position of the Plaintiffs/Applicants as duly elected members of the Executive Committee of the PDP in their respective local government areas, pending the determination of the motion on notice.
Similarly, the defendants, their agents, servants, privies or anybody acting under their authorities were restrained from suspending or expelling the Plaintiffs/Applicants or taking any step capable of affecting their membership of the party, pending the determination of the motion on notice which has been fixed for October 8, 2008.
